ATTENTION
An EVICTION has been filed against you in the 18th Judicial District Court of Kansas. Enclosed is a copy of the Petition for Eviction and an Eviction Summons to appear at the eviction answer hearing.
This hearing is your opportunity to respond to the Petition for Eviction and tell the court how you want to proceed. There will not be a judge at the hearing. The Plaintiff (landlord) and their attorney may attend the hearing, but they are not required to be there.
YOU HAVE TWO OPTIONS TO RESPOND TO THE PETITION:
1) Appear in person at the date, time, and place on the Eviction Summons. If you choose to appear in person, you should bring this packet, including the Petition for Eviction, with you.
OR
2) File a written answer with the court on or before the scheduled hearing date. If you file a written answer on or before the scheduled hearing date, you are not required to appear at the hearing.
If you fail to file a written answer or appear in person as described above, the judge may grant a default judgment against you. If a default judgment is granted and you have not moved out of the property, the judge may issue an order to have you removed from the property. This could happen very quickly, even within 24 hours.
If you want to file a written answer, you can find a blank answer form and instructions on the Kansas Judicial Council website:
https://www.kansasjudicialcouncil.org/legal-forms/civil

Once completed, you must print the answer form and file it at the Civil Clerk’s Office on the 11th floor of the courthouse. They are open 8:00 a.m. to 4:00 p.m. Monday through Friday. Follow instructions to serve the answer form to your landlord.
